Here are the Cineworld terms and conditions, privacy information and legal notices for all the services we provide. They are subject to change and can be updated on a regular basis.

 


1. Online Term of Use

1.    Minimum Age 
You must be aged 16 or over to use this Web Site, book tickets online, download or use a Cineworld app, register for a My Cineworld account or post on Cineworld social media pages.  If you are aged under 16, please ask your parent or guardian to book cinema tickets for you.  Our competitions and promotions are usually for adults aged 18 or over, so please check the rules before entering.

2. Use of our Web Site

2.1.    The following terms (the "Terms") apply when you visit, use or download any Cineworld Web Site, Cineworld iPhone App, Cineworld Android App or the Cineworld Facebook Booking App (each and together the "Web Site"), so please read them carefully.


2.2.    In these Terms, “Cineworld” means: 
2.2.1.    if you are in the UK or the Channel Islands “Cineworld” means Cineworld Cinemas Limited, a company registered in England and Wales under company number 01915767 with registered address at 8th Floor Vantage London, Great West Road, Brentford, TW8 9AG, United Kingdom and VAT number 606197048 and where relevant each company’s affiliates, holding companies and subsidiaries:    
2.2.2.    if you are in the Republic of Ireland “Cineworld” means Adelphi-Carlton Limited (trading as Cineworld Cinemas), a company registered in the Republic of Ireland under company number 7640 with registered address at 8th Floor, Block E, Iveagh Court, Harcourt Road, Dublin 2, Republic of Ireland and VAT number 8B41247E and where relevant each company’s affiliates, holding companies and subsidiaries.


2.3.    By accessing or using the Web Site, you accept and agree to be legally bound by these Terms and acknowledge that Cineworld has the right to amend or vary these Terms and any of the contents of the Web Site from time to time at its sole discretion.  Amendments or variations will take effect when they are posted on the Web Site, so you should check the current version of the Terms each time you use the Web Site.  These Terms, as amended or varied from time to time, apply to all use of, access to and downloads from the Web Site, both now and in the future.


2.4.    Additional terms and conditions may apply for any purchases made through the Web Site or your use of any apps.  If so, you will be prompted to view such additional terms and conditions on our Web Site or when using the apps or at the time of making such purchases and those terms and conditions will apply in addition to these Terms to the extent that the context permits.

3. General Disclaimer

3.1.    Although Cineworld has attempted to provide accurate information on the Web Site, Cineworld assumes no responsibility for the accuracy or completeness of such information.  Except as stated elsewhere in these Terms you release Cineworld from any liability, for any claims, losses or damages arising out of or in any way connected with your use of the Web Site.  


3.2.    To the fullest extent permitted by law and except as stated elsewhere in these Terms, Cineworld shall not be liable to any person or entity for any direct, indirect, special, consequential or incidental damages, including (without limitation) lost profits or revenues, loss of opportunity, costs of replacement goods or services, loss or damage to data or business interruption, arising out of or related to:
3.2.1.    any access to or use of or inability to access or use the Web Site, any other hyperlinked web site or any other information or product included or described within the Web Site; or
3.2.2.    your or any other person or entity's reliance on the information presented,
3.2.3.    in each case whether arising in tort (including negligence), contract or otherwise even if you have advised Cineworld of the possibility of such damages.


3.3.    All information and content provided on the Web Site is provided "as is" without representation or warranty of any kind, either expressed or implied. Without limiting the foregoing, Cineworld does not represent or warrant that the Web Site or any of its contents are accurate, current, complete, free from technical or typographical errors, free from changes or harmful components introduced by third parties or free from periodic interruption or errors of any other type.  Cineworld may revise the information or change the products or services mentioned on the Web Site at any time without notice. Any mention of non-Cineworld products or services is for information purposes only and constitutes neither an endorsement nor a recommendation of them. Neither Cineworld, nor their suppliers, make any representation or gives any warranty, condition or undertaking, expressed or implied, including (without limitation) as to the satisfactory quality, fitness for a particular purpose, suitability or non-infringement of any third party right or freedom from viruses, whether or not arising from a course of dealing, usage or trade practice.


3.4.    Nothing within these Terms limits or restricts any person's liability for death or personal injury resulting from its negligence or that of its employees or agents.


3.5.    These Terms and any disputes or claims arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales and you can bring proceedings in the English Courts. However, if you live in Scotland, the Republic of Ireland or The Channel Islands the relevant law will apply and you can choose to take action against Cineworld in your local courts.


3.6.    Cineworld makes no representation that the content or materials on the Web Site are appropriate or available for use in other jurisdictions. Access to the Web Site's content or its materials from jurisdictions where such access is illegal is prohibited.  If you choose to access the Web Site from other jurisdictions you do so at your own initiative and risk and are responsible for compliance with all relevant local laws.  Cineworld is not responsible for any violations of law as a result of your actions.

4. Trade marks and other such rights

4.1.    The trade marks and logos ("Marks") displayed on the Web Site are the property of Cineworld or other third parties.  You are not permitted to use these Marks without the prior written consent of Cineworld or the relevant third party proprietor of the Marks, and you acknowledge that any such use may constitute an infringement of the relevant proprietor's rights.


4.2.    You acknowledge that all intellectual property rights in all materials on the Web Site remain the property of Cineworld or the relevant third party proprietor, licensor or other content owner.  Except as expressly permitted herein, no portion of the information on the Web Site may be reproduced in any form, or by any means, without prior written permission from the Mark owner.


4.3.    You must not use any part of the content on the Web Site for commercial purposes without obtaining a licence to do so from us or our licensors.

5.1.    The Web Site contains links to third party web sites.  Access to any other web site through a link on the Web Site is at your own risk and Cineworld is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on these sites or the security of any link or communication with those sites.


5.2.    Cineworld reserves the right to terminate a link to a third party site at any time.


5.3.    The provision of advertisements for third party goods or services or a link to a third party web site through the Web Site does not mean that Cineworld endorses, authorises or sponsors those products and services or that web site nor does it mean that Cineworld is affiliated with the third party web site's owners or sponsors. Cineworld provides these links merely as a convenience for you and other visitors to our Web Site.

6. Web site security

6.1.    You agree not to corrupt (or attempt to corrupt) any data or to circumvent (or attempt to circumvent) any of the security safeguards of Cineworld or any of its suppliers.


6.2.    You acknowledge that the Internet is not entirely secure and whilst Cineworld and our payment providers take all reasonable steps to safeguard the security of any payment information you provide through encryption methods, Cineworld shall not be liable for any damage that you may suffer as a result of the loss of confidentiality of any such information.

7. Online ticket purchases and fees

7.1.    The following terms apply when you purchase tickets through the Web Site (which, for the purposes of these terms and conditions, will include purchases made using the Cineworld iPhone App, the Cineworld Android App and the Cineworld Facebook Booking App).  


7.2.    Use of tickets purchased online will be subject to the terms and conditions set out in the Cineworld Terms of Entry, which forms part of these Terms. It is important you read the Terms of Entry before booking tickets as refunds will not be given where you or a member of your party are refused entry to the cinema for non-compliance with those terms.  Please note: 
7.2.1.    Arriving later than the advertised performance time or start of the feature presentation may mean admission is refused; 
7.2.2.    proof of entitlement for any concessions/student/discounted/Unlimited tickets booked online must be shown to a Cineworld employee or representative on request at the cinema;
7.2.3.    entry to a film may be refused if the customer is under the minimum age required by the British Board of Film Classification or the Irish Film Classification Office for a screening and cannot prove to a Cineworld employee or representative at the cinema that they are at least the minimum age required. 


7.2.4.    In order for children under the age of 12 to be admitted after 7.00pm they must be accompanied by a parent or guardian.  Children under the age of 8 must be accompanied by someone who is at least 18 years of age at all times (regardless of the film classification). 


7.3.    By requesting tickets through the Web Site, you are placing a booking request for tickets on the Terms that is only deemed accepted by and binding on Cineworld once valid payment has been processed and you have been sent an email confirmation of your booking.


7.4.    Subject to certain exemptions as set out in Clause 7.5 below, a booking fee for each person for whom a seat is booked (“Booking Fee”) will be payable by you when purchasing tickets through the Web Site.  The Booking Fee is in addition to the price of a ticket and will be added as a separate charge during the booking process. The amount of the Booking Fee payable at the time of booking tickets is published on screen during the ticket booking process. The Booking Fee is non-refundable. If you do not wish to pay the Booking Fee, you may purchase tickets at the cinema in person, where it will not apply, although prices for tickets purchased in cinema may be higher or lower than those purchased online. By confirming your booking, you agree to pay the Booking Fee, in addition to the price payable for tickets. 


7.5.    Currently, the Booking Fee is not payable in relation to:
7.5.1.    tickets booked online using an Unlimited Card (although where tickets for other customers are booked as part of the same transaction, the Booking Fee will apply in respect of those additional persons for whom seats are booked);
7.5.2.    tickets for carers of disabled customers where the person the carer is accompanying can show a valid Cinema Exhibitors’ Association Card (CEA card) or locally issued disability card;
7.5.3.    tickets redeemed pursuant to certain promotions where the relevant terms and conditions of the promotion state that the Booking Fee is not payable; and
7.5.4.    tickets purchased for specific charity screenings.


7.6.    Tickets are sold at the prices stated on the Web Site at the time of purchase. Please note that prices for tickets may vary depending on the film and may change between the date of purchase and the date of the relevant performance. Where the price paid for the tickets differs to the price for equivalent tickets available for purchase at the time and date of the performance, Cineworld will not charge for and you may not claim any refund of the difference.


7.7.    The email confirmation of a booking will set out the details of the cinema tickets purchased, the total amount paid, a unique booking reference number (“booking reference”) and a QR code for use as an e-ticket (”e-ticket”).   


7.8.    Tickets must be presented for scanning by a member of Cineworld staff at the ticket check point to gain entry to the booked screening. 


7.9.    You may use the e-ticket in your chosen Cineworld cinema as your cinema ticket. Tickets can be displayed on your mobile device, printed at home or collected in cinema (see below).  Please note, the e-ticket QR Code will no longer work where tickets have been printed at the cinema box office or at a cinema ATM and the printed tickets must be used.


7.10.    Tickets are dispensed in-cinema by one of our automatic ticket collection machines or can be collected at the Box Office or Ticket and Concession stand of your selected Cineworld cinema.  You will need to present the payment card used to make a booking or the booking reference in order to collect the relevant tickets in-cinema.  


7.11.    If an e-ticket is used to admit a group, all members of the group, including you, must be admitted into the performance together and you must be able to provide proof of ticket purchase for all members by showing the relevant e-ticket at all times during your visit (including during a performance) if requested by Cineworld staff.


7.12.    Cineworld will endeavour to operate its cinemas in accordance with its advertised programme. However, there will be instances when its ability to show a performance is impaired by circumstances beyond its control.  In such situations, Cineworld reserves the right to cancel a performance, vary the time it shows it or provide customers with an alternative performance.  If Cineworld does have to cancel a performance, your sole remedy shall be a refund of the admission price paid for the relevant tickets and, where appropriate, booking fees, and no other costs.


7.13.    Bookings may not be amended although, if you have a valid My Cineworld account, tickets booked online through your My Cineworld account on the website or mobile app may be cancelled online through the My Bookings section of your account or View e-tickets on the app. These cancellations may be made up to 120 minutes (2 hours) prior to the start of the booked performance provided the tickets have not already been collected at the cinema. Funds will usually be returned to the same payment method used to make the booking (or if not possible, on a Cineworld gift card/e-voucher, via BACS transfer or other method at Cineworld’s discretion). Please note, previously charged booking fees and any additional fees for SMS confirmation or 3D glasses will not be refunded and redeemed voucher codes cannot be re-used. Tickets purchased at the cinema, booked online without using a My Cineworld account or booked online with a My Cineworld account but collected in-cinema prior to cancellation will not be refundable.


7.14.    You may purchase cinema tickets on behalf of yourself and friends and family, but you must not re-sell those tickets or offer them for re-sale.

8. My Cineworld and My Cineworld Plus

Access to My Cineworld
8.1.    To register for or use a My Cineworld account the applicant must be resident in the UK or Ireland and aged 16 years old or over. 


8.2.    In addition to the other sections of these Terms and the Privacy Policy, the following Terms apply to (i) the My Cineworld area of the Web Site, (ii) registration for and use of a My Cineworld account, (iii) purchase of My Cineworld Plus and any use of the My Cineworld Plus Discount (see clause 8.15) and My Cineworld Plus Offers (see clause 8.16).


8.3.    Applicants may register for a My Cineworld account for themselves by signing up and submitting their details on the My Cineworld registration page on the Web Site here, via one of the Cineworld Apps  or on the Web Site during the ticket booking process. Each person may only have one My Cineworld account at any time.


8.4.    Applicants will need to provide their name and a valid email address, when signing up for a My Cineworld account. A confirmation e-mail message will be sent by Cineworld to the e-mail address provided when registering for the account. Applicants must confirm their e-mail address by clicking the “Confirm E-mail” button or the link provided in the confirmation e-mail to complete registration.  


8.5.    Unlimited members aged under 16 (Junior UL Members) wishing to use their Unlimited membership to book tickets for themselves online must ask the parent or guardian who pays their subscription fee to register a managed My Cineworld account for them, within the parent or guardian’s own My Cineworld account. The Parent or Guardian will require a separate email address to complete the registration verification process for the managed My Cineworld account. Once the Parent or Guardian has completed the Managed Account registration and verification process other My Cineworld users may add the Junior UL Member’s Unlimited card number to their own My Cineworld account using the ‘Add Unlimited Friends & Family’ function. Any requests submitted using the Junior UL member’s Unlimited card number appear in the Parent or Guardian’s My Cineworld account to be accepted, rejected or removed. Once accepted, a user can book a ticket for the Junior UL Member by selecting their Junior UL member’s Unlimited card number during the booking process using the ‘Add Unlimited Friends & Family’ option. The Junior UL Member will not be able to login or request a password for the managed My Cineworld account until they are 16 years old.  


8.6.    Access to the My Cineworld area of the Web Site and to My Cineworld accounts is restricted to authorised users only. Unauthorised individuals attempting to access the My Cineworld part of the Web Site or any My Cineworld account may be subject to prosecution.


8.7.    The Account Holder is solely responsible in all respects for any use of the username and password which the Account Holder selects when registering for a My Cineworld account. The Account Holder must not share their password with, or transfer it to, anyone else.


8.8. If the Account Holder becomes aware of any unauthorised use of their username and password, they must notify Cineworld immediately via the online contact form or by emailing [email protected]. Cineworld will not be responsible for any such unauthorised use.

 

Information provided
8.9.    Once the verification stage has been completed, Account Holders may also provide optional extra details such as their phone number and home address in their My Cineworld account profile and save their payment details in the Payment Methods section.  Account Holders may choose and change their Favourite Cinema in the preferences section of their account profile at any time. If no Favourite Cinema has been selected, a Favourite Cinema will be automatically allocated based on the cinema chosen for the first online ticket booking using the My Cineworld account (and may be changed by the Account Holder online at any time thereafter).


8.10.    Cineworld will use personal information provided during the registration process and in Account Holders’ My Cineworld accounts to provide the My Cineworld facilities, functions and services and where relevant the benefits of the Unlimited membership available through a My Cineworld account and the My Cineworld Plus upgrade including My Cineworld Plus Discount and My Cineworld Plus Offers. The Privacy Policy contains more detail about how Cineworld collects and uses Account Holders’ personal information. Account Holders should read it carefully and make sure that they understand it before registering for a My Cineworld account.


8.11.    When communicating with Account Holders Cineworld will use the contact information (email address and phone numbers) provided in the Account Holder’s My Cineworld account. It is therefore important that Account Holders keep their contact details updated.


8.12.    Account Holders may update contact details and other personal information including their marketing preferences at any time through their My Cineworld account.

 

My Cineworld Plus (no longer available to purchase or renew)
8.13.    Account Holders must be aged 16 years or older to purchase My Cineworld Plus. 


8.14.    Account Holders with a valid My Cineworld account may purchase My Cineworld Plus as an upgrade in the Account area of their My Cineworld Account or during the ticket booking process. Customers who don’t already have a My Cineworld account will be given the option to purchase My Cineworld Plus at the same time as registering for a free standard My Cineworld account.  A valid My Cineworld account is required to be able to enjoy My Cineworld Plus Discounts and My Cineworld Plus Offers (see below for more details)


8.15. My Cineworld Plus is a paid-for upgrade to the standard (free) My Cineworld account. My Cineworld Plus (referred to as “My Cineworld Plus” or “My Cineworld Plus upgrade”) is valid for a period of 12 months from the date of purchase (“Upgrade Period”) and entitles the Account Holder to a discount on the standard price of cinema tickets the Account Holder books online via their My Cineworld account (“My Cineworld Plus Discount”) during the Upgrade Period. The level of discount available when using the My Cineworld Plus Discount will be the level of discount published on the Web Site at www.cineworld.com/benefits at the time of purchase of My Cineworld Plus (although please note the level of discount may vary and be changed from time to time in accordance with clauses 8.21 and 8.22 below). The My Cineworld Plus Discount does not apply to the price of 3D glasses, booking fees such as those referred to in clause 7.4 (whether or not they are shown as included in the price of the ticket online), SMS confirmation fees, or any other items or services which may be purchased online via the Web Site, unless otherwise stated.

8.16.    Cineworld may also make other offers available to the Account Holder at the time of purchase of their My Cineworld Plus upgrade (“My Cineworld Plus Offers”). Such offers are discretionary and may be withdrawn or changed by Cineworld from time to time without notice. Details of the My Cineworld Plus Offers available to Account Holders at the time of purchase of their My Cineworld Plus upgrade (if any) will be published on the Web Site and information about how to use them will be included in the email confirmation of purchase.

8.17.    The My Cineworld Plus Discount is for personal use by the relevant Account Holder and may not be transferred, sold or otherwise shared on social media. Purchase of My Cineworld Plus will not give Account Holders any preferential rights of access for any screenings over other Cineworld customers and the My Cineworld Plus Discount and My Cineworld Plus Offers may not be used in conjunction with any other promotions offered by Cineworld unless otherwise stated (please see clause 8.18 below for use of My Cineworld Plus Discount and Offers in conjunction with Unlimited Cards).
8.18.    My Cineworld Plus is available for purchase by Unlimited members who are also Account Holders. To use the My Cineworld Plus Discount in conjunction with an Unlimited Card the Unlimited member will need to link their Unlimited membership with their My Cineworld account by following the instructions in their My Cineworld account and completing the verification steps as displayed on screen. The My Cineworld Plus Offers may be used in conjunction with relevant discounts and offers available with the Unlimited Card unless otherwise stated.

 

How to purchase My Cineworld Plus (no longer available to purchase or renew)
8.19. The My Cineworld Plus upgrade will be valid for a period of 12 months from the date of purchase ("Validity Period") unless cancelled or terminated earlier in accordance with these Terms. A valid My Cineworld account is required for the duration of the My Cineworld Plus Validity Period. Closure/deletion of the Account Holder's My Cineworld account during the Validity Period will automatically cancel the My Cineworld Plus upgrade (including the Account Holder's ability to access or use any My Cineworld Plus Discounts and My Cineworld Plus Offers) and no refund of the Upgrade Fee will be provided (unless cancelled during the Cancellation Period (see clause 8.23)).


8.20. When the My Cineworld Plus upgrade expires at the end of the Upgrade Period the Account Holder’s My Cineworld account will automatically continue with the benefits of the My Cineworld (free) account and the Account Holder will be able to use their My Cineworld account as normal but the My Cineworld Plus Discount and My Cineworld Plus Offers will no longer apply.


8.21. Cineworld may withdraw or amend any offers made to Account Holders (or other customers) or online facilities or functions available within the My Cineworld area of the Web Site including those applicable to any My Cineworld accounts, and any related Terms, at any time without notice. Any such changes will be posted on the Web Site but Account Holders will not be specifically notified.


8.22. Cineworld may withdraw My Cineworld Plus or change the My Cineworld Plus Discount, any other element of My Cineworld Plus and related Terms from time to time. Any such changes will be posted on the Web Site but Account Holders will not be specifically notified unless they are material changes applicable to them. Where the changes are to ensure compliance with law or regulation, or for security reasons, or are non-material, the amended discounts and/or terms will take effect when posted. Where the changes to My Cineworld Plus or related Terms are material, the Account Holder will be notified by email and the amended discounts and/or terms will take effect on the date specified in the email notice. If these changes are to the Account Holder’s disadvantage, the Account Holder may terminate their agreement with Cineworld in relation to their My Cineworld Plus upgrade (see clause 8.23 below). Please see clause 8.16 for further details regarding amendment and withdrawal of My Cineworld Plus Offers.

 

Cancellation rights
8.23. If the change(s) made pursuant to clause 8.22 are material and to the Account Holder’s disadvantage, the Account Holder will have 30 days from the notice date in which to terminate their agreement with Cineworld for their My Cineworld Plus upgrade. The Account Holder must notify Cineworld in writing of their request to terminate. On termination of an Account Holder’s My Cineworld Plus upgrade under this clause 8.23 Cineworld will refund an amount equal to the value of the Upgrade Fee for the number of remaining full months of the Upgrade Period after the date of termination. Refunds will be paid back to the credit, debit or charge card used for the relevant transaction or on a Cineworld Gift Card or e-Gift Voucher. On termination, Cineworld will deactivate the My Cineworld Plus upgrade to the Account Holder’s My Cineworld account.


8.24. Cineworld may terminate, withdraw or suspend the My Cineworld area of the Web Site including the My Cineworld accounts at any time for any reason on reasonable notice in writing to the Account Holder. In this event, where an Account Holder has purchased My Cineworld Plus, Cineworld will refund an amount equal to the value of the Upgrade Fee for the number of remaining full months of the Upgrade Period after the date of termination.


8.25. Cineworld may immediately suspend and/or terminate an Account Holder’s My Cineworld account if:
8.25.1. Cineworld suspects any fraud in any matter connected to the registration for or use of a My Cineworld account or any My Cineworld Plus upgrade;
8.25.2. the Account Holder or anyone else misuses their My Cineworld account, Unlimited membership via their My Cineworld account, My Cineworld Plus Discounts or My Cineworld Plus Offers, for example sharing them with others on social media or using them other than for reasonable personal use;
8.25.3. the Account Holder commits any other material breach of these Terms which cannot be corrected or if it can be corrected has not been corrected within a reasonable time; or
8.25.4. the Account Holder engages in any behaviour or activity that is disruptive to or damaging to any Cineworld business or operation, process or practice, including breaching Cineworld’s Terms of Entry.


8.26. Cineworld may keep any Upgrade Fees that have been received in respect of an Account Holder’s account which has been suspended or terminated pursuant to clause 8.25. This right does not limit any other rights Cineworld may have against the Account Holder.

 


Validity period and renewal of My Cineworld Plus
8.27. If Cineworld fails to comply with this clause 8 of these Terms (My Cineworld and My Cineworld Plus), we are responsible for loss or damage Account Holders suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time of registration for My Cineworld or purchase of My Cineworld Plus, both Cineworld and the Account Holder knew it might happen.


8.28. Cineworld does not exclude or restrict its liability for fraud, for death or personal injury resulting from its negligence or that of its agents and nothing in this clause shall operate to exclude, restrict or limit this liability.

8.29. Cineworld will not be in breach of these Terms or otherwise be liable for any delay in performance of them to the extent that such breach or delay is due to circumstances beyond its reasonable control.


8.30. English law governs these terms and all aspects of the relationship between Cineworld and the Account Holder for the registration for and use of a My Cineworld account, any purchase of My Cineworld Plus and use of any My Cineworld Plus Discount or My Cineworld Plus Offers, unless the Account Holder’s residential address at the time of purchase of My Cineworld Plus is in Scotland, when Scottish law applies or in Ireland, when Irish law applies. Cineworld will only write and communicate with the Account Holder in English.


8.31. If the Account Holder’s residential address is in the UK or The Channel Islands, the agreement for the purchase of My Cineworld Plus will be with Cineworld Cinemas Limited. If the residential address is in Republic of Ireland the agreement for the purchase of My Cineworld Plus will be with Adelphi-Carlton Limited.

 

Suspension and termination of My Cineworld and My Cineworld Accounts
8.32.    Cineworld may terminate, withdraw or suspend the My Cineworld area of the Web Site including the My Cineworld accounts at any time for any reason on reasonable notice in writing to the Account Holder. In this event, where an Account Holder has purchased My Cineworld Plus, Cineworld will refund an amount equal to the value of the Upgrade Fee for the number of remaining full months of the Upgrade Period after the date of termination.


8.33.    Cineworld may immediately suspend and/or terminate an Account Holder’s My Cineworld account if:
8.33.1.    Cineworld suspects any fraud in any matter connected to the registration for or use of a My Cineworld account or any My Cineworld Plus upgrade;
8.33.2.    the Account Holder or anyone else misuses their My Cineworld account, Unlimited membership via their My Cineworld account, My Cineworld Plus Discounts or My Cineworld Plus Offers, for example sharing them with others on social media or using them other than for reasonable personal use;
8.33.3.    the Account Holder commits any other material breach of these Terms which cannot be corrected or if it can be corrected has not been corrected within a reasonable time; or
8.33.4.    the Account Holder engages in any behaviour or activity that is disruptive to or damaging to any Cineworld business or operation, process or practice, including breaching Cineworld’s Terms of Entry.


8.34.    Cineworld may keep any Upgrade Fees that have been received in respect of an Account Holder’s account which has been suspended or terminated pursuant to clause 8.33. This right does not limit any other rights Cineworld may have against the Account Holder.

 

Applicable Law and Liabilities
8.35.    If Cineworld fails to comply with this clause 8 of these Terms (My Cineworld and My Cineworld Plus), we are responsible for loss or damage Account Holders suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time of registration for My Cineworld or purchase of My Cineworld Plus, both Cineworld and the Account Holder knew it might happen.


8.36.    Cineworld does not exclude or restrict its liability for fraud, for death or personal injury resulting from its negligence or that of its agents and nothing in this clause shall operate to exclude, restrict or limit this liability.


8.37.    Cineworld will not be in breach of these Terms or otherwise be liable for any delay in performance of them to the extent that such breach or delay is due to circumstances beyond its reasonable control. 


8.38.    English law governs these terms and all aspects of the relationship between Cineworld and the Account Holder for the registration for and use of a My Cineworld account, any purchase of My Cineworld Plus and use of any My Cineworld Plus Discount or My Cineworld Plus Offers, unless the Account Holder’s residential address at the time of purchase of My Cineworld Plus is in Scotland, when Scottish law applies or in Ireland, when Irish law applies. Cineworld will only write and communicate with the Account Holder in English.


8.39.    If the Account Holder’s residential address is in the UK or The Channel Islands, the agreement for the purchase of My Cineworld Plus will be with Cineworld Cinemas Limited.  If the residential address is in Republic of Ireland the agreement for the purchase of My Cineworld Plus will be with Adelphi-Carlton Limited.

9. Booking Events Online

9.1.    To book one of our cinemas for a birthday party, private hire or school trip (“Event”) using the Cineworld Events online booking pages you must be resident in the UK and aged 18 years old or over. 

Access to Events Accounts 

9.2.    You will need to register for a free online Cineworld Events account (“Events Account”) on the Cineworld Events pages to complete your Event booking online.  

9.3 Your registration for and use of an Events Account and online Event booking services will be governed by these Cineworld Online Terms of Use and the Cineworld  Privacy Policy.  The Cineworld Event Bookings Terms and Conditions and Cineworld Terms of Entry will also apply to any booking you make for an Event

9.4.    To register for an Events Account you must complete the on-screen registration process which includes submitting your details on the Cineworld Events registration page on the Web Site here. You may only have one Events Account at any time.

9.5    You will need to provide your name and a valid email address, contact details (including telephone number, region) and organization type (Personal, School, corporate/business) when signing up for an Events Account. You will also need to create a password for your Events Account (at least 8 characters long, containing at least one each of the following: upper case letter, lower case letter, a number and special character as indicated on screen).  We will send a verification e-mail message to the e-mail address you provide when registering for the Events Account. You must confirm your e-mail address by clicking the “Confirm E-mail” button or the link provided in the verification e-mail to complete your registration.  

9.6    Access to the Cineworld Events area of the Web Site and to Events Accounts is restricted to authorised users only. Unauthorised individuals attempting to access the Cineworld Events part of the Web Site or any Events Account may be subject to prosecution.

9.7    You are solely responsible in all respects for any use of the login details (email address and password) which you select when registering for an Events Account. You must not share your password with, or transfer it to, anyone else.

9.8 If you become aware of any unauthorised use of your Events Account login details, you must notify Cineworld immediately via the online contact form or by emailing [email protected]. Cineworld will not be responsible for any such unauthorised use.

Information Provided

9.9.    Once the verification stage has been completed, you will be able to continue and complete any Event booking requests and payments within your Events Account and also (if you choose) save your payment details in the payments section.  

9.10.    We will use the personal information you input during the registration process and in your Events Account to provide the Events Account facilities, functions and services and when fulfilling your Event bookings. The Privacy Policy contains more detail about how Cineworld collects and uses your personal information. Please ensure you read these Terms and the Privacy Policy carefully and make sure you understand it before registering for an Events Account.

9.11.    We will use the contact information (email address, phone numbers and postal address) provided in your Events Account to contact you in connection with your Events Account and any of your Event booking requests and confirmed Event bookings. It is therefore important that you keep your contact information updated. 

9.12   You may update your contact information within your Events Account at any time, although please note that changes or cancellations of any Event bookings may only be made in writing by contacting [email protected].  

9.13    We may also use your contact information to send you information about new film releases and private screening special offers (“Events News and Offers”).  If you would prefer not to receive our Events News and Offers you can unsubscribe at any time by clicking the unsubscribe link in any of the Events News and Offers messages.

Suspension, termination and changes to online Event bookings, Event Accounts and these Terms 

9.14   We may withdraw or amend the Events area of the Web Sites or the online facilities or functions available therein including those applicable to any Events Accounts, and any related Terms, at any time without notice. Any such changes will be posted on the Web Site but you will not be specifically notified.

9.15.   We may immediately suspend and/or terminate your Events Account if:

9.15.1    we suspect any fraud in any matter connected to the registration for or use of an Events  Account (including in relation to any Event bookings made);

9.15.2    you or anyone else misuses your Events Account;

9.15.3    you engage in any behaviour or activity that is disruptive to or damaging to any Cineworld business or operation, process or practice, including breaching the Terms, Cineworld’s Terms of Entry or Event Bookings Terms and Conditions.
This right does not limit any other rights Cineworld may have against you.

Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time of registration for an events account, both Cineworld and you knew it might happen.  The Cineworld Event Booking Terms and Conditions sets out our sole liability in the event we fail to comply with the terms of any confirmed booking for an Event.

10.4.    We accept payment by the debit, credit and charge card, relevant gift cards and other payment methods, such as Paypal, listed on the Web Site at the time of your purchase. You must provide the payment card or payment wallet account details as indicated on screen during the payment process.  Our payment service providers will use those details you provide to process the payment on our behalf. Transactions will appear on the cardholder’s bank, card or payment wallet statement as a payment to Cineworld for purchases in UK or The Channel Islands and Cineworld or Cineworld Cinemas Adelphi for purchases in Ireland.

10.5. All transaction details, including payment card details, are encrypted using Transport Layer Security. Further, Cineworld seeks to ensure that bank details are not transmitted in clear text through the Cineworld booking system.

12.1. 12.2.    Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to use alternative dispute resolution. 

12.3.    For customers in Republic of Ireland only: The European Commission has established a website for online dispute resolution which is available at www.ec.europa.eu/consumers/odr, and which is designed to assist consumers in resolving disputes online without having to go to court.

13. Other important information

13.1.    The failure of Cineworld to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right.

13.2.    Cineworld may assign, transfer or, where permitted by law, declare a trust over the benefit of its rights and obligations under these Terms to any party at any time without notice to you.  You may not assign, transfer or declare a trust over your rights or obligations under these Terms without Cineworld's prior written consent, which may be withheld at our absolute discretion.

13.3.    Cineworld will not be in breach of these Terms or otherwise liable for any delay in performance of them to the extent that such breach or delay is due to circumstances beyond our reasonable control.

13.4.    If any part of these Terms is unenforceable, invalid or illegal (including any provision in which Cineworld excludes its liability to you), the enforceability, validity or legality of any other part of these Terms will not be affected or impaired in any way.

13.5.    Any notice to be given by either party to the other may be sent by email or recorded delivery to the address of the other.  In the case of Cineworld, this address shall be Cineworld Cinemas, 8th Floor Vantage London, Great West Road, Brentford, TW8 9AG, or by email to [email protected], or such other postal or email address as may be published in these Terms from time to time.  Cineworld will send notices to you at the address you provided at the time of registration or such other address you have since notified to us in writing or by email to [email protected] or via your My Cineworld account.  If sent by email, a notice shall be deemed to be received on the day it was sent or, if sent by recorded delivery, shall be deemed to be served two days following the date of posting.

13.6.    Some of the provisions of these Terms are for the benefit of Cineworld and its officers, directors, employees, agents, subsidiaries, affiliates, suppliers and third party information providers.  Each of these persons or entities shall have the right to assert and enforce those provisions directly against you on its own behalf if you violate any of these Terms.  Save for the foregoing, the Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms and no rights or benefits expressly or impliedly conferred by them shall be enforceable under that Act against the parties by any other person.

13.7. •    Condoning or encouraging breaking the law or participating in unlawful activity including breach of copyright (or other intellectual property rights), defamation and contempt of court

•    Advertising products or services for profit or gain
•    Seen to impersonate someone else
•    Including contact details such as phone numbers, postal or email addresses
•    Written in anything other than English
•    Linking to other websites which also break any of the guidelines mentioned in this list

14.2 We ask that any contributors of user generated content on our website;
